Question: What if the tenant will not allow anyone in the unit to treat for Bed Bugs?
Answer: Response by Alex Galindo (Legal Aid) - If a tenant fails to assist in the eradication of a Bed Bug infestation, the landlord will probably have an argument that the landlord has made a diligent effort to repair/remedy the Bed Bug infestation and that the tenant is therefore not entitled to the remedies under the Texas Property Code such as the right to terminate the lease, the tenant will not have a right to repair or remedy the condition, the right to repair/remedy and deduct the costs for the repair/remedy, or to seek judicial remedies. In addition, the landlord depending on what the lease provides, may be entitled to terminate the lease.
